1. Preamble
These Terms and Conditions of Sale define the conditions under which Grayson the Wolf (trade name), operating as an illustrator (hereinafter referred to as the “Service Provider”), provides original illustration services.
The “Client” refers to any natural person or legal entity making use of these services. The term “Third Party” refers to any person or entity not party to this agreement.
Payment validation by the Client constitutes a firm order for the agreed services and acceptance of these Terms and Conditions. The relationship between the Client and the Service Provider shall be governed exclusively by these Terms and Conditions, to the exclusion of any other terms.
2. Commission Process
The Client may contact the Service Provider through any preferred communication channel (social media or email). During the initial discussion, the following information will be established:
- The Client’s brief, including the concept or general idea of the illustration, clear and legible reference images, additional references if necessary, the desired format, the chosen medium (digital or traditional), the level of finish, and any other relevant information regarding the project.
- Payment terms (price estimate and payment method). A base price list is available; however, the final price may vary depending on the complexity of the commission.
- The Client’s signature or written confirmation stating that they have read and accepted these Terms and Conditions.
The Service Provider reserves the right to refuse any commission deemed inappropriate, including but not limited to content involving hate speech, excessive violence, gore, fetish content, incest, pedophilia, or bestiality, without being required to provide justification.
The Service Provider also reserves the right to refuse a commission if the Client behaves disrespectfully toward the Service Provider or their work.
The Client is permitted to publish the finished artwork online, provided that proper credit is given to the Service Provider in the relevant publication.
3. Pricing and Payment
Prices are listed on the Service Provider’s website and confirmed during written communication. The Service Provider undertakes to calculate prices as fairly as possible. Once the Client accepts the quotation, an invoice will be issued. Late payment may result in a warning or cancellation of the commission.
Payment shall be made via PayPal, Tiime, or any other payment method agreed upon by both parties, in Euros (€). Additional fees, such as currency conversion fees or PayPal transaction fees, may be added to the invoice.
Once payment has been received, the Service Provider agrees to complete the commission within one month at the latest, except in cases of exceptional circumstances beyond their control.
Should the Service Provider cancel the commission, any amounts already paid shall be refunded to the Client. However, if part of the work has already been completed and delivered to the Client (such as sketches or preparatory work), the Service Provider may retain an amount corresponding to the value of the completed work. This amount shall be proportional to the work actually completed and clearly communicated to the Client.
4. Approval and Liability
Once payment has been received, the Client will receive an initial sketch of the commission. This sketch serves as the primary approval stage, during which the Client may request adjustments or modifications.
Once the Client explicitly approves the sketch in writing, the commission will proceed to completion. If major changes are requested after this approval stage or once the artwork has been completed (except where the requested changes are justified or result from an error made by the Service Provider), the Service Provider reserves the right to charge additional revision fees or refuse further modifications.
The Service Provider undertakes to produce work that reasonably reflects the Client’s original request but cannot guarantee the Client’s subjective appreciation of the final artwork. The Service Provider’s liability shall be limited to demonstrable errors.
The Client agrees to provide accurate information, including reliable reference images and correct contact and shipping information, and remains solely responsible for any consequences resulting from inaccurate or incomplete information.
5. Delivery
Upon completion of the commission, the Service Provider shall deliver one or more high-quality, high-resolution digital files for digital commissions.
For printed artwork, shipping costs shall be borne by the Client unless otherwise agreed.
If the delivered artwork does not conform to the agreed commission due to an error attributable to the Service Provider (such as an incorrect commission, manufacturing defect, or packaging issue), the Service Provider agrees to remedy the situation as promptly as possible. Return shipping and replacement shipping costs shall be covered by the Service Provider.
If the issue results from an error attributable to the Client (such as an incorrect or incomplete shipping address, inaccurate order information, or modifications requested after approval), any additional shipping or reshipping costs shall remain the responsibility of the Client.
If a parcel is damaged during transit, the Client is requested to notify the Service Provider as soon as possible and provide photographs of both the parcel and its contents to facilitate a claim with the shipping carrier. Each case will be assessed individually.
The Service Provider shall not be held liable for delivery delays caused by the shipping carrier or by circumstances beyond their reasonable control, including but not limited to force majeure, strikes, severe weather conditions, or logistical disruptions.
6. Applicable Law and Copyright
The Service Provider does not accept commissions from minors.
The Client agrees to respect the Service Provider’s copyright. The delivered artwork may not be altered from its original form, claimed as the Client’s own, modified without the Service Provider’s consent, traced, counterfeited, used for commercial purposes without prior authorization, or incorporated into artificial intelligence systems (including machine learning, AI training datasets, NFTs, blockchain technologies, or any other for-profit platform).
Any use contrary to this non-exhaustive list is strictly prohibited and may result in legal action.
By placing an order, the Client acknowledges having read, understood, and accepted these Terms and Conditions without reservation.
